In case you missed it, the Supreme Court just junked SolGen Calida’s quo warranto petition vs ABS-CBN’s franchise yesterday.
To the Kapamilya supporters, this is something to cheer about after an agonizing month or so wondering when they can watch their favorite Kapamilya stars again on TV.
However, Atty. Nick Nañgit of the FB page Nick Nañgit – NCN Law, a known Duterte supporter, is playing the spoiler’s role and wants to stop the Kapamilya fans, figuratively speaking, from popping their wines to welcome the news.
In a Facebook post, Atty. Nick Nañgit opened by expressing his intention of talking about the issue.
‘Bago mag bunyi ang mga shunga at magpakalat na naman ng kung anik anik na balita, eto basahin muna.’
Atty. Nick said he already expected the dismissal because when SolGen Calida filed the petition, ABS-CBN’s franchise has yet to expire.
‘Expected ko na itong pag-dismiss ng Korte Suprema, dahil noong isinampa sa buwan ng Pebrero ni Sol Gen Calida ang Quo Warranto (QW) laban sa Katol ay hindi pa paso ang prangkisa nito.’
Atty. Nick remarked that the purpose of the quo warranto was to nullify the franchise. However, when the franchise expired, it was natural that the SC decision was dismissal because it is already “moot”.
‘Ang layunin ng QW ay ipawalang bisa ang prangkisa. Kaya lang, nitong Mayo pumaso na ang prangkisa. Pwes, ano pang prangkisa ang ipapawalang bisa, gayung wala na ngang prangkisa. Natural ang hatol – dismissal, dahil “moot” na.’
Atty. Nick added that tackling the issue further was unnecessary. The intent of the QW was to nullify the franchise and since the franchise has expired, there’s no point of settling the issue.
‘Hindi na rin kailangang talakayin pa ang ibang mga isyu, dahil wala na itong saysay o patutunguhan. Ang hinihiling ng QW ay ipawalang bisa ang prangkisa, kaso wala na ngang prangkisa.’
Hindi maaaring lumagpas ang korte sa layunin o kahihinatnan ng isang QW. Gaya nang ilang beses ko nang nasabi sa radyo at naisulat na rin dito, hindi nagbibigay ng payo o advisory opinion ang Korte Suprema.
So what is the meaning of this? Atty. Nick said that since the SC dismissed the QW, the Kapamilya has emerged victorious.
‘HINDI ibig sabihin na nanalo ang Katol. Walang ganun mars. Ang ibig sabihin lang ay nasaan ang prangkisang ipapawalang bisa, gayung wala na nga ang prangkisa. Tapos ang usapin.’
‘Ano ang susunod na mangyayari?’ Atty Nick asked.
Atty. Nick told the public to wait for Congress to wrap up its hearing on ABS-CBN franchise and the voting. ‘Hintayin natin ang pagdinig at botohan sa Kongreso.’
If Congress vote against ABS-CBN’s request to get a new franchise, Atty. Nick remarked that the fight is over. ABS-CBN cannot file for motion for reconsideration or appeal in the courts because it’s Congress alone who grants franchise.
‘Pag bumoto sila na wag nang bigyan ng prangkisa ang Katol, pwes tapos na ang laban. Hindi ito pwedeng ipa-mosyon para ikonsiderang muli. Uulitin natin, walang ganun mars. Apply na lang ulit sila. Hindi rin sila makaka-apela sa korte, dahil hindi naman ito ang nagbibigay ng prangkisa, kundi Kongreso.’
Meanwhile, ABS-CBN’s frequencies can now be granted to pending applicants from other media entities. At this juncture, Atty. Nick wants to know the status of NTC’s CDO. Was it lifted or not?
‘Samantala, pwede nang ipagamit sa ibang naka-pending na aplikasyon ng ibang media ang frequency na ibinalik na ng Katol sa Estado/Republika. Sa puntong ito, ano na ang resolusyon ng NTC sa CDO? Na-lift ba ito o hindi na? Bakit kaya tahimik?’
If Congress decides to grant ABS-CBN a new franchise, Atty. Nick said happy days is back, particularly the Kapamilya fans. The President can veto it but Congress can override Duterte’s veto power though.
‘Pag bumoto naman sila na bigyan pa rin ng prangkisa ang Katol, pwes balik ligaya ito. May kapangyarihan pa ring i-veto ito ng Pangulo, pero pwede pa rin ito i-override ng Kongreso.’
In case there is a violation or an anomaly in the law granting of the new franchise, a quo warranto petition can be filed by the SolGen. According to Atty. Nick, no one can question the process of crafting the bill because there is such a thing as “enrolled bill doctrine” and the executive respects the legislature as a co-equal body.
‘Kung sakaling may katiwalian na masilip sa batas na magbibigay ng bagong prangkisa sa Katol, gaya ng mga dati nang isyung inihain sa QW, maaaring magsampa muli ang Sol Gen ng panibagong QW. Hindi pwedeng kuwestiyunin ang proseso ng paggawa ng batas, dahil may “enrolled bill doctrine” at iginagalang ng adhidukatura ang lehislatura na isang kapantay at hiwalay na sangay ng pamahalaan.’
Atty. Nick ended the FB post by leaving the public and particularly the Kapamilya something to chew on before going out in streets to party to welcome the news of the SC dismissing SolGen’s QW.
‘Yun nga lang, tandaan, nandiyan pa rin ang Presidential Decree 576-A, ang pagkamamamayan ni Gabby Lopez, at ang epekto ng PDRs sa posibleng pagmamay-ari at pamamahala ng mga dayuhan sa mass media.’
