‘Tama ka, Shawie. Aralin muna ang batas, lalo ka na.’ — Lawyer fan of Sharon Cuneta advises actress after her socmed rant vs Duterte supporter

‘Tama ka, Shawie. Aralin muna ang batas, lalo ka na.’

This is the reaction of a pro-Duterte lawyer named Nick Nañgit of the FB page Nick Nañgit – NCN Law following Sharon Cuneta’s tirade against a Duterte supporter who threatened to r@p* megastar’s daughter if he was a 12 year old kid.

ICYMI, Sharon Cuneta vented her motherly rage against a DDS supporter who identified himself as Sonny Alcos in her socmed account.

Moving forward, Atty. Nick said that if Sharon read the post of Sonny Alcos carefully, the latter used the word “KUNG” or IF in English when he made the statement. Meaning, if he lower his age to 12 years old and below, under the Juvenile law, he won’t go to jail.

‘Kung binasa mong maigi ang sinabi ni Sonny, ginamit niya ang salitang KUNG. Ang ibig niyang sabihin ay kapag ibinaba niya ang edad niya sa edad na saklaw ng batas, hindi siya makukulong.’

Atty. Nick explained that Sonny Alcos made the statement to open the eyes of the public the effect of Kiko Pangilinan’s Juvenile law. He said someone who is not full of rage but think in a calm manner will perceive Sonny Alcos statement in a manner different from Ms. Sharon Cuneta.

‘Sinabi niya yan, para makita ng lahat ang epekto ng batas na yan. Ito ang dating sa isang tao na hindi puno ng galit, kundi kalmado ang pag-iisip. Kung baga sa isang huwes, babasahin ang isinulat niya nang walang namumuong panghuhusga agad.’

‘Suriin natin,’ Atty. Nick urged Sharon Cuneta to dissect with him Sonny Alcos statement.

Atty. Nick said not all people will take things the same way as Sharon Cuneta. He made it clear he understood Sharon’s reaction because she has every right to get mad as the mother but he told Sharon she had taken Sonny Alcos statement out of context.

‘Hindi lahat ay kagaya mo kung umintindi. Oo, nanay ka ni Frankie, karapatan mo ang magalit, pero iba ang konteksto ng sinabi ni Sonny.’

Atty. Nick agreed with what Sonny said that hat a 12 year kid won’t go to jail. He can use the example of an imaginary victim but he used Sharon;s daughter as an example because Frankie commented on the culture of r@p* (even if there is no such thing, if she knows how to understands the word culture).

‘Totoo ang sinabi ni Sonny na hindi makukulong ang isang dose anyos na bata. Maaari niyang gamiting halimbawa ang isang imaginary victim, pero ang ginamit niyang halimbawa ay ang anak mo, dahil nag komento ito tungkol sa kultura ng panggagahasa (kahit walang ganun, kung marunong siyang umintindi sa salitang kultura).’

Atty. Nick asked Sharon Cuneta if Frankie can’t be used as an example, to drive home a point, when her father was the author of the bill? (Of course, Sonny did not use KC as an example because his father was not Kiko.)

‘Hindi ba pwedeng gamitin si Frankie na halimbawa, just to drive home the point na ang ama niya mismo ang nag panukala ng batas na yan? (Syempre, hindi ginamit ni Sonny si KC, dahil anak mo ito sa ibang lalaki.)’

Atty. Nick remarked that in light of Sharon’s statement, he asked if her daughters are untouchables? If her daughters are used as an example, does it automatically mean the guy was being disrespectful? Is she in the pedestal of saints? He joked he wasn’t informed. Turning serious, Atty. Nick made it clear the discussion isn’t about women but the possibility of a minor committing r@p* who cannot go to jail. Atty. Nick asked if Sharon gets his point.

‘Sa mga sinabi mo Shawie, ano ang anak mo, untouchable? Pag ginamit siyang halimbawa, kawalan agad ng respeto? Nasa pedestal ba siya ng mga sinasanto? Di ata ako na-inform. Hindi ito usapin na babae siya, kundi usapin ito ng posibleng panggagahasa ng isang menor de edad na hindi makukulong. Gets mo?’

On why a 12 year old r@pist won’t go to jail? Atty. Nick explained below.

‘Bakit hindi makukulong? Dahil nga, ayon sa batas, sa murang edad na 12 ay hindi pa nito nauunawaan ng lubusan ang tama at mali, pati ang kawalan ng kalayaan pag gumawa ng krimen.’

On Sonny Alcos deactivating his socmed accounts, Atty. Nick commented that it is within his rights.

‘Kung tinanggal man ni Sonny ang mga socmed accounts niya, karapatan niya yun. Marami siyang pwedeng maging dahilan, at hindi ang dahilan lang na naiisip mo. Wala kang pake sa gusto niyang gawin at hindi makokontrol yan ninuman.’

Atty. Nick reminded Sharon she can get sued if she said words that are defamatory in nature or threaten a person. He told Sharon to consult her husband and if she refuses to involve him, she better study the law.

‘Kung naghahamon ka naman ng away sa socmed, naisip mo rin ba na ikaw mismo ay pwedeng makasuhan kapag nanira ka ng puri o nagbanta. May batas diyan. Tanungin mo asawa mo o, better yet, since ayaw mo siyang ipasok sa eksena, aralin mo na lang.’

At this point, Atty. Nick asked Ms. Sharon Cuneta what case she is contemplating against Sonny Alcos?

‘Balikan natin ang sinabi ni Sonny. Anong ikakaso mo, libel? Threats?

If she answers libel, Atty. Nick gave Ms Cuneta a brief lecture on the law, particularly libel.

Kapag inaral mo ang batas, nakasaad sa Artikulo 353 ng Revised Penal Code na ang libel ay isang “public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status or circumstance tending to cause dishonor, discredit or contempt of a natural x x x person x x x.”‘

Atty. Nick went to enlighten Ms. Sharon Cuneta that filing a case against Sonny Alcos is futile merely because he made a hypothetical statement to drive home a point.

‘May isinapubliko bang sinabi si Sonny na malisyosong paratang (hindi basta malisya, kundi paratang) ng isang krimen, bisyo, o depekto na magdudulot ng kawalan ng dangal sa anak mo? Isipin mong maigi.’

Atty. Nick also talked about grave threats in case the megastar is contemplating on filing grave threats against Sonny Alcos because if she was, he dissuade Ms. Cuneta not to proceed because she will just waste her time and effort.

‘Ang nakasaad naman sa Artikulo 282 ng parehong batas, ang grave threats ay kapag may “threaten another with the infliction upon the person, honor x x x of any wrong amounting to a crime x x x”.’

Atty. Nick asked Sharon Cuneta if Sonny Alcos threatened to r@pe Frankie? If he did, under PH law, making threats isn’t enough. It must be serious, heavy and there is a big possibility, the threat is carried out.

‘May pagbabanta ba si Sonny na gagahasain niya si Frankie? At saka sa ilalim ng batas, hindi sapat ang basta banta. Dapat seryoso, mabigat, at tutuparin ang pagbabanta, hindi ngawmgaw lang, kahit may Cybercrime Prevention law na tayo. Aralin mo rin yan.’

Besides, Atty. Nick said that Frankie is over 18 years old and it’s Frankie alone who can file a case even if Sharon rant and rant on socmed. He called it emancipation.

‘At saka, lagpas 18 na ba ang anak mo? Ang tawag diyan, age of emancipation. Si Frankie ang pwedeng maghabla ng libel, cyber libel, o grave threat, hindi ikaw, kahit ina ka pa, kahit mag ngawa ngawa ka pa, kahit mag alipusta ka pa. Nasa batas din iyan. Aralin mo na naman yan.’

Atty. Nick informed Ms. Sharon Cuneta about a thing called impossible crime in our legal system and that is why Sonny Alcos won’t go to jail if ever the actress decides to go to court.

‘Wag nating kalimutan na hindi naman maibabalik na ang panahon at bumata muli si Sonny. Kaya’t sa ilalim ng batas, ang tawag diyan, kung sakali man may paratang o banta, ay “impossible crime”. Nadagdagan na naman ang aaralin mo.’

Atty. Nick said it was shocking and a huge minus points to Sharon’s stature, even if she is a billionaire who ranted and feeling entitled indeed.

‘Nakakagulat lang at nakabawas ng malaki sa iyong pagkatao, kahit bilyonarya ka pa (dahil yun ang inispluk mo sa buong mundo sa isa mong socmed brouhaha), na dumakdak kang feeling entitled ka pala.’

Atty. Nick went on to cite three reasons why Sharon’s stature in his eyes has diminished.

‘Una, ipinagmamalaki mong kaibigan at abugado mo ang DoJ Secretary. Weno ngayon kung kaibigan mo siya?! Ibig mo bang sabihin na dapat matakot na si Sonny sa iyo? Lumabas tuloy ang kulay mo.’

‘Kahit mali ka, basta’t may kakilala ka e magiging tama ka, ganun ba yun? Yan ang sistemang palakasan na dapat buwagin sa ating lipunan. Pero, imbes na maging bahagi ka ng pagsasaayos ng ating bansa (dahil tinitingala ka bilang isang artista at mangaawit), dumadagdag ka pa sa pagkabulok ng sistemang yan at ipinagmamalaki mo pa na may kaibigan kang mataas na tao, kaya dapat katakutan ka.’

‘At saka, hindi mo na siya abugado, dahil DoJ Secretary na siya. Hindi mo siya pwedeng kunin para ipagtanggol ka sa korte. Aralin mo talaga ang batas o paturo ka naman please.’

‘Pangalawa, ipinagyabang mo pa “kung sino ako”, “anak ni Pablo P. Cuneta (na dating alkalde), “mali ang binangga mo”, at ti-nag mo pa talaga ang mayora ng Davao City na anak ng Pangulo. E di wow!’

‘Ibig mo bang sabihin, dahil malaki kang tao (literally and figuratively), anak ng pulitiko, at may koneksyon, e hindi ka dapat kinakalaban? Ke tama o mali ka, always right ka teh? At kung maliit na tao naman, hindi anak ng pulitiko, at walang koneksyon, e pwede niyang kalabanin? Ganun ba yun?’

‘Teka muna pala, kinalaban ka ba ni Sonny o nag imagine ka lang na kinalaban ka niya? Ni hindi nga niya binanggit ang pangalan mo. So, bakit ka ngumangawa? Hindi na bagets ang anak mo. Sa ilalim ng batas, magkasuhan man sa korte, wala kang personalidad. Sa showbiz ka lang merong personalidad, sa korte wala. Batas yan. Ang dami mo nang aaralin.’

‘Pangatlo, tinawag mo si Sonny na aso at unggoy. Maging ang Diyos mo, tinawag mo rin para tulungan siya sa iyong pagbabanta. Does that make your “God proud”? Ay, onga, sabi mo rin pala sa Twitter mo, trying your best ka lang. Ika nga sa kanta, you did your best, but your best wasn’t good enough.’

Atty. Nick clarified though he does not know Sonny Alcos personally. He is an independent thinker and like he said earlier, Sharon’s true color has been exposed.

‘Alam mo, Shawie, hindi ko kilala si Sonny. Independent thinker ako. Oo’t inilabas mo ang galit mo bilang isang ina, pero wala ka sa lugar. At gaya ng nasabi ko na, lumabas ang totoo mong kulay.’

Atty. Nick, who called himself a not so big fan of the megastar, ended the talk by leaving Sharon Cuneta some words of wisdom for the actress to ponder on.

‘Sana iwasto mo ang iyong pagkakamali.

Payo ito na hindi mo man hiningi o kinailangan, galing naman sa isang maliit na fan mo (dati).

Nakakapanghinayang. Hindi talaga nabibili ng pera ang tamang ugali.’
