‘Something fishy! Yung totoo! — Lawyer’s reaction on Bantay Bata no longer accepting scholars

Uh-oh! Bantay Bata will no longer accept new applicants for scholarship due to limited funding?

That’s what Bantay Bata Director Jing Castaneda announced via ABS-CBN News lately.

In his latest FB post with the title ‘Ubos na Katol’, Atty. Nick Nañgit briefly discussed this “fishy” development. Why fishy? Continue reading below.

Atty. Nick opened the post with a question to the Bantay Batay Director Jing Castaneda why the limited funding when the source of their funds come from donors?

‘Jing, bakit may “limited funding” ang Foundation? E sa mga donors nanggagaling dapat ang pera!’

Atty. Nick asked further clarification on the nature of the relationship of the Foundation with Katol or ABS-CBN? To think that they have separate registration and corporate purposes?

‘At anong kinalaman ng Foundation sa Ubos na Katol? Separate ang registration at corporate purposes nila, so paano naging “business operations” yan ng Ubos na Katol?’

‘Nahuhuli talaga ang isda sa bibig!’ Atty. Nick wrote.

And here’s more. Atty. Nick noted that the Bantay Bata Director Jing Castaneda thanked the scholars, not the other way around. He can’t help but point this out.

‘At lalong teka, bakit baligtad ang pasasalamat. Pilit ninyong gagamitin ang mga naka-graduate?!’

Just so everyone knows, Atty. Nick stated that the Foundation was given the opportunity to do good because its social mission said so in its Articles of Incorporation.

‘Ang Foundation ninyo ang binigyan ng oportunidad na gumawa nang kabutihan, dahil nakalagay ang social mission na yan sa “primary purpose” ng inyong Articles of Incorporation sa SEC!’

Another thing that caught the attention of Atty. Nick was the particular line in the message of the Bantay Bata Director Jing Castaneda saying that the scholars have opened their hearts. Atty. Nick couldn’t help but ask the Bantay Bata Director to explain this.

‘Anong binuksan ng mga estudyante ang puso nila? Hindi ba’t dapat kayo ang nagbukas ng pinto para tulungan sila?!’

Atty. Nick went on to remind the Bantay Bata Director the fact that it was only ABS-CBN who was not given a franchise, not the Foundation. He made sure they are on the same page by asking a follow up question.

‘Teh, ang hindi binigyan ng prangkisa ay ang Ubos na Katol, hindi ang Foundation. Nakarehistro pa yan sa SEC. Pag nag dissolution na ang Ubos na Katol, pati ang Foundation dissolved na rin?’

Atty. Nick summed up his FB post with this telling line below.
