Singer-composer Jimmy Bondoc and currently serving the Duterte administration has taken to Facebook to advice the public, regardless of their political affiliation, not take VP Leni Robredo’s word that the gag order is unconstitutional and even unrealistic. “Whatever your political inclination, pls know that this statement by Mam Leni is absolutely false, legally.”
Bondoc said the sub judice rule or gag order has already been adopted by our courts. “The sub judice rule has been adopted by our courts, as it relates to the rules on contempt.”
Bondoc elaborated that the rule bars the public to talk about the case publicly. “Simply put, pinagbabawal po talaga sa batas natin ang pag-usapan publicly ang isang kaso na sumasailalim na sa pagdinig ng korte, lalo na ng Korte Suprema.“
Bondoc informed the public that this rule of courts is not an invention or a work of fiction of the Duterte admin. “Matagal na pong batas iyan, at hindi inimbento ng administrasyon na ito. Kahit sino pa mang Pangulo ang nakaupo, wala po itong kinalaman o epekto sa pagpapatupad ng sub judice.“
Bondoc said that this rule makes no exemption whether you are a popular showbiz personality or a public official. You cannot even claim freedom of speech because it has also limitations including one’s rights. ‘Wala pong arti-artista o sinupamang kapangyarihan ang maaaring lumabag sa batas sa sub judice rule. Kahit po ang Freedom of Speech ay hindi absolute right, dahil ang lahat ng karapatan ay may hangganan.“
Bondoc remarked that Robredo is a lawyer but why she made that statement is already beyond his understanding. “Abogado si Mam Leni kaya sigurado rin po na alam niya ito. Kung bakit niya sinabi itong statement na ito ay lagpas sa aking pag-unawa.“
