“Kapag mamalasin talaga.” — Jay Sonza on ABS-CBN’s pending franchise bill while Congress has 4 session days left before Holy Week break

Kapag mamalasin talaga.” Retired broadcaster Jay Sonza reckoned that if you are to suffer bad luck, for sure bad luck will keep coming. Not the pretty translation but that’s the gist.

As the Americans say, “if it rains, it really pours.”

Sonza said that “Stop means STOP. Period.” The former ABS-CBN broadcaster was apparently referencing the privilege of ABS-CBN to use Philippine airwaves. Without a franchise, they can’t continue like its business as usual.

Sonza figured that with barely 4 session days left, congress is preoccupied with leadership in-fighting which could last until May, it is nearly impossible for Congress to pass ABS-CBN’s franchise bill.

To add more woes to ABS-CBN’s misery, Sonza said “Congress will go on a Holy Week break beginning March 14 and will resume session on May 4, 2020 in time for expiration of the legislative franchise.”

In short, Sonza declared “it is just impossible for the application to be tackled at all until midnight of the same day.”

Meanwhile, Sonza has some bad news to the senators who filed a resolution expressing the sense of the chamber for the National Telecommunications Commission to grant ABS-CBN Corporation “provisional authority” to broadcast until June 30, 2022 or the end of 18th Congress“Batay sa dalawang desisyon ng Korte Suprema, hindi maaring magpatuloy ng pagsasahimpapawid ang alinmang network kung wala ng bisa ang prangkisa (SC Decision NO FRANCHISE NO BROADCAST base on the decided cases of Ang Nars Partylist, and Associated Broadcasting).”

In other words, Sonza puts it this way- “a provisional permit to operate cannot be issued by the National Telecommunications without a valid legislative franchise regardless if there are endorsements, joint or concurrent resolutions from Congress.”

Sonza added that the “pending Quo Warranto Petition against ABS-CBN isn’t even factored in this particular instance.

Well, Sonza isn’t done breaking the bad news for the supporters of ABS-CBN and the Kapamilya network. “In the meantime, all television and radio frequencies allocated to the Kapamilya Network will be recalled by NTC on May 5, 2020.”

Sonza have some good news too for the Kapamilya Network once they secure a new franchise. “However, the company can apply for a new PPTO and Certificate of Public Convenience and new frequency allocation as soon as their application for a new franchise is approved by Congress and signed into law by the President.”

But there is a BIG if. “Iyan naman ay kung Hindi matatalo ang abs-cbn sa kasong dinidinig ng SC at hindi sila disqualified to apply for a new franchise.”

Sonza made it clear that ABS-CBN Broadcasting Corp. is not being shut down. They will just disappear in FREE TV and radio. “Uulitin ko lang po, ABS-CBN Broadcasting corporation is not being shutdown or closing shop. Mawawala lamang sila sa FREE TV and Radio.”

If you subscribed to these Lopez-owned companies, expect to continue receiving services from these companies. “SkyCable and TFC are distinct and separate companies.”
