However, to grant his motion, the court had set several terms and conditions for his travel.
Binay is not allowed to leave the Philippines earlier than June 8 and must not return later than June 30.
Within five days after his return, Binay must present himself to the court bringing his passport and photocopies of relevant documents pertaining to his departure and entry to the Philippines. He must also present himself not later than five days from his departure date if the former Makati City Mayor decides not to take the said trip.
Last month, the former VP Jejomar Binay and Junjun Binay also filed motions asking the court to travel to Israel. The two were granted permission to travel from May 15 to 19.
The said pilgrimage was the last one which Father Gustilo will lead. Father Gustilo was the former Father Provincial of the Salesian Fathers in the Philippines.
"It is very important to note that Movant is almost 75 years old and a family man. Movant believes that this pilgrimage to the Holy Land is an exceptional case for a devout Catholic," Jejomar stated in his motion.
The Binays are charged with an alleged conspiracy along with other officials, granting a contract to Mana Architecture and Interior Design, Co. for designing the Makati City Hall Building II project.
The project did not hold a public bidding.
According to the Ombudsman "despite its failure to deliver the approved plans and specifications under the contract.", a total payment of P11,011,294.77 were given to MANA.
Also from the Ombudsman, the father and son Binay also granted three more contracts to Hilmarc’s Construction Corporation for Phases One, Two and Three of the project totaling to P1.486 billion. The contracts were awarded through a rigged or "simulated public bidding" although there we no approved budget appropriation, project plan, and specifications.
The former Vice President is charged of four counts of graft, nine counts of falsification of public documents and one count of malversation while his son is facing two counts of grafts and one count of malversation.
